Question: we have several currently laid off former full time employees, who when working full time were eligible for holiday pay...for over two years many have worked on an as needed basis as fill ins if work is available...a day or two here and there, but unfortuneately no more than ten days in a row...if their return stint falls within the paid holiday time frame, are they entitled to be paid for the holiday?
Yes, laid-off employees who were eligible for holiday pay when they were working full-time may be entitled to be paid for holidays that occur during their return stint, even if they have not worked more than ten days in a row.
Eligibility for Holiday Pay Full-Time Employees
Generally, employees who work full-time for an employer are eligible for holiday pay.
Laid-Off Employees
Laid-off employees who were eligible for holiday pay when they were working full-time may maintain their eligibility even after being laid off.
Return Stint Within Holiday Time Frame
If a laid-off employee returns to work during the paid holiday time frame, they are eligible for holiday pay.
Worked Any Days
It does not matter if the employee only worked a day or two during their return stint. As long as they were working on the day of the holiday, they are entitled to be paid.
Exceptions
There may be exceptions to this rule depending on the specific terms of the employer's holiday pay policy. Some employers may have policies that require employees to work a certain number of hours or days in a row to be eligible for holiday pay.
Recommendation
To avoid any disputes, employers should clearly communicate their holiday pay policy to employees, including any exceptions or requirements for eligibility. Flag for review
